Terms & Conditions for the Sale of Tickets via the Garnizon Internet Ticket Sales System

1) Definitions

        a) ‘Terms & Conditions’ means these Terms & Conditions for the purchase of tickets via the online ticket sales system available at tickets.garnizon.pl

        b) ‘Website’ - means the website available at tickets.garnizon.pl, of which the Seller is the administrator.

        c) ‘Seller’ - Hossa.biz Sp. z o.o. with its registered office in Gdańsk, at Cypriana Kamila Norwida 1, registered in the Register of Entrepreneurs of the National Court Register maintained by the District Court Gdańsk - Północ in Gdańsk, VII Division of the National Court Register under KRS no. 0000295112; NIP 586 22 06 966, Regon 220520462, share capital: PLN 1,000,000.00;

        d) ‘Organiser’ - Hossa.biz Sp. z o.o. with its registered office in Gdańsk, at Cypriana Kamila Norwida 1, registered in the Register of Entrepreneurs of the National Court Register maintained by the District Court Gdańsk - Północ in Gdańsk, VII Division of the National Court Register under the number KRS 0000295112; NIP 586 22 06 966, Regon 220520462, share capital: PLN 1,000,000.00;

        e) ‘Ticket’ - confirmation of the User's single entitlement to participate in a specific event, organised by the Organiser, available for purchase via the Website in the form of a PDF file;

        f) ‘User’ - a person using the Website to purchase or book a Ticket;

        g) ‘Payment Site’ - the tpay.com website, administered by Krajowy Integrator Płatności spółka akcyjna with its registered office in Poznań, Plac Andersa 3, 17th floor, 61-894 Poznań, entered into the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań Nowe Miasto and Wilda in Poznań, VIII Division of the National Court Register under KRS number 0000412357, NIP 7773061579, REGON 300878437,

2) General provisions

        a) These Terms and Conditions set out the rules for purchasing and booking Tickets via the Website.

        b) The User is obliged to read these Regulations prior to purchasing Tickets through the Website.

        c) The User is obliged to use the Website, and purchase and redeem Tickets, in compliance with these Terms and Conditions and applicable law.

3) Orders

        a) The purchase of a Ticket is made by placing an order for a Ticket via the Website and paying the amount due resulting from the order via the Payment Site, by the rules specified in the Regulations.

        b) Placing an order is made each time the Buyer goes through a path consisting of the following steps:

  1. selection of the number and type of tickets to be ordered,
  2. providing the User's data (first name, surname, e-mail address, mobile telephone number),
  3. acceptance of the order cost and purchase rules, and payment for the booked tickets via tpay.com,
  4. Confirmation of the completed order will be sent to the e-mail address provided in the order.

        c) The User shall have the right to order Tickets from the current offer of the Seller, the sale of which shall be enabled by the Seller through the Website.

        d) The Seller has the right to freely decide when to start and end the sale of Tickets for a given event via the Website.

        e) A user who has placed an order will receive a ticket in PDF format via email, which will be sent to the address provided when placing the order.

        f) The Organiser shall not be liable for any loss of the Ticket by the User.

4) Payments

        a) Payment for the tickets ordered shall be made at the time of ordering via tpay.com.

        b) Orders unpaid within 15 minutes are automatically cancelled.

5) Delivery

        a) Tickets shall be delivered, in the form of electronic tickets in PDF format, by e-mail to the address specified in the order.

        b) The Buyer shall be obliged to check the tickets received to ensure that they conform to the order.

        c) If the ordered tickets are not received despite payment, the Buyer shall contact the Seller's ticketing system operator at: bilety@garnizon.pl for assistance.

6) Fulfilment of tickets

        a) The purchaser must present the Tickets either on their mobile device screen or, if this is not possible, as printed copies.

        b) Entry to the event requires presentation of the Tickets, either electronically or in printed form, to the cashier or ticket collector for verification.

7) Refunds

        a) A Ticket which is not redeemed in the manner indicated in clause 6 of the Terms and Conditions shall not be exchanged or refunded unless otherwise stated in this clause.

        b) The User may return the Ticket only:

            ▪ in the event of cancellation of the event for which the Ticket is valid;

            ▪ in the event of any other circumstance which prevents the fulfilment of the purchased Ticket, attributable to the Seller.

        c) The right to return a Ticket does not apply in the case of circumstances preventing the realisation of the purchased Ticket, lying solely on the User's side, including a change in the User's decision.

        d) In the event of cancellation of an event, the Seller shall immediately inform the Users of this fact in the form of an email sent to the email address indicated in the order.

        e) The User, to retain the right to return the Ticket, should notify the Seller of the return:

            ▪ electronically, within 7 days from the date of the event to which the Ticket pertained or, respectively, within 7 days of the Seller sending information about the cancellation of the event.

        f) If a refund is requested, the Seller shall, within 14 days of receipt of the request:

            ▪ Refund the payment automatically from the ticketing system to the account from which the purchase was made.

Upon receipt of a refund request, the Seller shall refund the payment automatically via the ticketing system to the account used for the purchase within 14 days.

8) Withdrawal from the Agreement

  1. A User purchasing a Ticket through the Website, under Article 38(12) of the Consumer Rights Act of 30 May 2014 (Journal of Laws of 2024, item 1796), is not entitled to withdraw from the Agreement concluded with the Organiser.

In accordance with Article 38(12) of the Polish Consumer Rights Act of 30 May 2014 (Journal of Laws of 2024, item 1796), a User purchasing a Ticket through the Website is not entitled to withdraw from the Agreement concluded with the Organiser due to the nature of the service provided.

9) Personal data

        a) The administrator of the personal data provided by the Users is Hossa.biz Sp. z o.o. with its registered office in Gdańsk, at Cypriana Kamila Norwida 1, registered in the Register of Entrepreneurs of the National Court Register maintained by the District Court Gdańsk-Północ in Gdańsk, VII Division of the National Court Register under KRS no. 0000295112; NIP 586 22 06 966, Regon 220520462, share capital: PLN 1,000,000.00. Your data will be processed for the purposes and to the extent related to your use of the Website, including the preparation and performance of the Ticket sales contract.

        b) By making a purchase, you consent to the processing of your data to the extent necessary for the fulfilment of your order, in particular to the provision of the required data to the organiser of the event for which the purchase is made and the fulfilment of the delivery.

        c) If provision of certain data is required, the Buyer agrees to provide accurate, complete, lawful, and truthful information and shall bear sole responsibility for any consequences arising from incorrect or misleading data.

10) Complaints

        a) The Purchaser shall have the right to complain about a malfunction of the ticketing system.

        b) Any complaint shall be made immediately after the situation giving rise to the need to make a complaint has arisen. A description of the situation shall be submitted with the complaint.

        c) All complaints shall be sent to the address indicated in the order confirmation or to the following address: bilety@garnizon.pl.

        d) The deadline for submitting complaints expires at the start of the event to which the complaint relates.

        e) Complaints shall be dealt with immediately, but no later than 30 days from the date of receipt.

        f) The complaint shall be answered by e-mail or in writing.

        g) Complaints concerning payments processed via tpay.com shall be handled directly by tpay.com in accordance with their terms and conditions, available on the tpay.com website. The Seller bears no liability for the performance of this service.

11) Other provisions

        a) It is prohibited for the Buyer to send information and content of an unlawful, offensive, or misleading nature, including content containing viruses or other harmful components.  In the case of sending such content, the Seller shall have the right to block the User's access to services provided electronically and take legal action for damages by the principles of the Civil Code.

        b) The Seller shall not be liable for any errors during the use of the service resulting from the misuse of the service by the Buyer. The Seller shall not be liable for the use of the service by the Buyer in a manner contrary to these Terms and Conditions.

        c) Should any part of these Terms and Conditions be invalid, the remaining provisions shall remain valid.

        d) Any amendments to these Terms and Conditions shall be binding from the moment they are published on the website: bilety.garnizon.pl.

Any disputes between the Seller and the Purchaser shall be submitted for settlement to a court of competent jurisdiction for the Seller.
